As a New York small-business owner, I write to express serious concern about the proposed New York Privacy Act — a proposal that could harm small businesses like mine by restricting the data we need to reach customers, compete with larger companies, and grow.

Small businesses utilize data-powered digital tools — such as data-driven ads and analytics from digital partners like Google, Shopify, and Constant Contact — to maximize their limited budgets, expand their reach to new and existing customers, and make informed business decisions. None of this involves personally-identifiable data — it’s simply about reaching the audiences most likely to be interested in our offerings and providing the tailored service our customers value.

The New York Privacy Act would restrict businesses from collecting more data than the minimum necessary to deliver a requested product or service. This goes far beyond other states’ restrictions on data and would result in fewer opportunities to connect with customers, higher advertising costs, and fewer data-based insights to inform business decisions — hurting thousands of New York small businesses like mine.

I respect our customers’ privacy and support sensible data privacy rules. But the New York Privacy Act goes too far. I urge you not to restrict the data that powers small businesses’ most effective digital tools.

Please oppose this extreme proposal before it does lasting harm to New York’s small business community.
