Illinois: Oppose HB 850 – Protect Due Process and Firearm Rights
Dear [Lawmaker],
I am writing to express my strong opposition to House Bill 850, which was rushed through the House with limited debate and no opportunity for public input. Originally introduced as a bill unrelated to firearms, HB 850 was amended on the floor to change the definition of "clear and present danger" under the FOID and CCL framework. This bill allows for automatic revocation of an individual’s FOID or CCL based solely on information from the Department of Human Services database. Even more concerning, HB 850 conditions the right to appeal a license revocation on surrendering all firearms and disclosing a complete list of owned firearms. By requiring citizens to give up their rights before they can even appeal, the legislation undermines basic due process. Additionally, by forcing individuals to exhaust all administrative remedies before seeking judicial review, HB 850 creates further delays and barriers to restoring Second Amendment rights. This bill is a direct threat to law-abiding gun owners and sets a dangerous precedent for the erosion of constitutional rights in Illinois. Please stand up for due process and the rights of your constituents by voting NO on HB 850.
